Social networks: Business boon or waste of time?

Not sure if your organization needs to use social networks to connect with customers and clients? There?s some new research on the topic that can help you.

A?new study from InSites consulting?has some interesting findings:

  • Facebook, Twitter and LinkedIn remain very popular, they provide a stable base in the social media landscape.
  • Rapid adoption of mobile Internet provides a further increase in the use of social media: mobile devices are clearly an accelerating factor.
  • The rising stars are Pinterest and Instagram. Consumers would prefer not to start a new social network, but there is always room for platforms with a unique function.
  • Half of consumers follow at least one brand through social media. On average, U.S. consumers interact with 6 brands actively and follow 15 passively through social media. The opportunity lies however in collaboration: 8 out of 10 consumers want to help companies offer better products and services. U.S. consumers want to participate in co-creation and companies are still insufficiently seizing the opportunity for the development of a profound ?consumer connection?.

Facebook, Twitter and LinkedIn are the most popular
The use of social media continues to increase around the world. In the United States, 8 out of 10 Internet users currently make use of social media. Facebook remains by far the most popular site (7 in 10 are active on Facebook), followed by Twitter (25%) and LinkedIn (24%). The study by InSites Consulting shows that the use of social media is stimulated by the increasing use of the number of smartphones in the world. Consumers with a smartphone make more intensive use of social networking sites than those without a mobile Internet connection. People with a smartphone are also more open to conversing with brands.

Smartphones lead to further growth of social media
44% of U.S. Internet users have a smartphone with an internet subscription, 17% have a tablet. The increase in the number of smartphones and tablets causes an increase in the use of social media. 73% of people with mobile Internet use social media every day, this is 63% for people without a mobile connection. Social media applications are also quite popular.

Pinterest and Instagram are the stars of the future
The InSites Consulting study confirms the popularity of the big three social networking sites. Facebook, Twitter and LinkedIn are still the biggest in the U.S.A. and around most of the world as well. It is moreover difficult for new social networking sites to quickly match the success of these three. The study shows that the average consumer is a member of two social networking sites. Usually this is Facebook and another site. Moreover, 95% of these users do not plan to leave and 60% do not want to create a new account. However, the study found two exceptions: Pinterest and Instagram. 10% of U.S. Internet users use Pinterest and 7% use Instagram. Both sites have the greatest growth potential. A large group of people are considering using these sites in the future.

?Consumers are clearly satisfied with the current offer of social networking sites. Only a small group of consumers keeps wanting something new. The vast majority prefer a status quo. Only sites that add something new arouse interest. This explains the success and potential of Instagram and Pinterest. Both sites offer something neither Facebook, Twitter nor LinkedIn have, hence the interest of consumers,? explains Schillewaert.

Consumers want to help companies on social media
A striking finding in this study is to what a great extent consumers are willing to help businesses. Half (53%) of U.S. social network users follow at least one brand. On average, users follow 15 brands passively and 6 brands interactively. Consumers expect these brands to primarily provide information about their products, launch attractive promotions and involve consumers to improve products. 81% of U.S. Internet users want to help brands and give them advice. They prefer doing so through a form of structural collaboration, ?consumer consulting boards? (or communities) ? more than 65% want to do so through a form of online communities. Consumers would prefer to help existing products (73%) and services (64%) improve, but also want to help think about the products of the future (65%).

?Most companies think only about the number of fans and likes, but not about active collaboration with customers. This is a missed opportunity! Consumers generate more and faster information than ever before, but also better and more complete information due to the fact that they integrate different media. By using mobile devices and electronics consumers also generate contextual consumption information that is illustrative and generated in the heat of the moment. Research communities or ?consumer consulting boards? offer a unique platform to engage consumers in the strategy of a company. Consumers want and can provide value for new product development, but also for the development of advertising and content marketing. Unfortunately, most companies do not yet see this opportunity,? concludes Niels Schillewaert, PhD, Managing Partner of InSites Consulting New York.

British Sports Mogul None Too Keen on Harvard?s ?Community Values? of ?Integrity? and ?Honesty? [Updated]

In early October,?Outside published a 5,000+ word expos? of Tough Mudder, the adventure racing company founded in 2010 by Will Dean, an alumnus of?Harvard Business School. The story is well worth reading in full for journalist Scott Keneally?s thorough assessment of the company?s rapid growth over the past two years. (Update: there?s also a trailer!)

What really snagged our attention, however, was Keneally?s survey of allegations that Will Dean stole the idea of Tough Mudder while he was a student at HBS.

The evidence of wrongdoing hinges on a Harvard-endorsed field study Dean performed at Tough Guy Limited, in the United Kingdom, where Dean is from. In a nut: after completing the field study, Dean submitted to Harvard and Billy Wilson (the proprietor of Tough Guy Limited) two different reports of his work:

In December, when Dean completed his report, he submitted one version to Harvard and a slightly modified one to Wilson. Both described the potential for more events, but the version he sent to Wilson omitted key recommendations for how he might immediately expand. Rather, he suggested Wilson adopt a wait-and-see approach. Wilson was unimpressed with the report, and the two men fell out of touch.

It?s sort of like The Social Network (minus the Trent Reznor soundtrack) ? except that Harvard eventually took action against Will Dean.

Keneally discusses an internal Harvard investigation that arose from a complaint Billy Wilson sent to the biz school?s faculty less than two weeks after Tough Mudder staged its first event in the spring of 2010. We recently got our hands on the text of the investigation?s final ruling, which?Outside quotes from, and it?s actually a bit more unsparing than the magazine lets on.

Harvard?s Conduct Review Board found that Dean lied, repeatedly, about the nature of his field study of Tough Guy Limited ? the company on which he based his own. (Another surprising revelation: that Harvard Business School ? alma mater of Rajat Gupta and Jeffrey Skilling, among others ? has ?community values?, and that those ?values? include ?honesty? and ?integrity?.)

Then on October 1, 2008, Will emailed TGL, opening with an apology for not being in touch sooner because ?I am afraid I have been pretty busy here with mid-term exams.? The semester was merely in its first month at that point, of course, (and few EC courses have mid-term exams in any event). In the message he also spoke of professors at Harvard Law School who ?have agreed to help us on this.? When asked in our interview who specifically had agreed to help, however, Will said he had sent out some e-mails to HLS faculty but had received no response. His statement to TGL about HLS involvement was a falsehood.

Keneally reports that Harvard ?placed Dean on alumni probation for five years.?

This case arises out of an allegation made by Tough Guy Limited (TGL), a UK-based company, about the conduct of William (Will) Dean (MBA 2009) while he was a second year student at HBS and subsequently. Specifically, it contends that he inappropriately used confidential information and related material provided by TGL which it provided in connection with an HBS Individual Student Research (ISR) project for his own development of an apparently similar commercial enterprise.

Will Dean has denied the allegations, stating: ?I refute all claims made by Bill Wilson (the CEO ofTough
Guy Limited). I have reviewed with my US and UK attorneys the guidelines for HBS ISRs and the HBS Community Values and am quite certain that I have in no way violated any guideline set out by Harvard.?

A Conduct Review Board (CRB) was convened to consider this matter. Its members included:

Process

The matter came to Harvard Business School?s attention on Friday, February 12, 2010, when Doug Brodie, a financial adviser at Master Adviser IFA Limited, contacted HBS Dean Jay Light by e-mail on behalf of Tough Guy Limited to make the allegation. In the ensuing weeks Gabe Handel, Managing Director, HBS Dean?s Office, gathered further information from Mr. Brodie, public sources, and internal HBS files.

Because the alleged conduct here is closely related to Will Dean?s academic work as an enrolled student, a Conduct Review Board was convened to find the facts in this case.

Brit Dewey, Director, Community Values Program, informed Will Dean on May 13, 2010, that HBS had submitted a complaint to the Conduct Review Board formally alleging that he had inappropriately used conflifential information and related material provided by Tough Guy Limited in connection with an HBS
Individual Student Research (ISR) project for his own development of an apparently similar commercial enterprise during his Elective Curriculum year at HBS. Brit then prepared a Preliminary Statement of Facts, based on her review of the due.diligence done by Gabe Handel, her interview of [redacted], and her initial correspondence with Will Dean. In response, Will submitted a written statement to the CRB formally denying the allegations made by Tough Guy Limited.

The CRB met on Monday, June 28, 2010, and it discussed the written record in order to formulate questions for Will, with whom it then met. At the end of its Interview with Will, the CRB discussed the case more fully.

Findings

After reviewing numerous documents and e-mail correspondence, and having interviewed Will Dean in person, the CRB finds that there is insufficient evidence to support the serious charge that he inappropriately used confidential informatoon and related material provided by Tough Guy Limited in
developing his own enterprise.

More specifically, the CRB concluded that the public and uncomplicated nature of businesses like TGL?s makes them largely understandable to bystanders without any special access to proprietary information. Indeed, Will was a spectator at a TGL event in the summer of 2008 where he gathered information by
taking extensive notes and speaking informally with participants. This activity was in advance of any HBS academic work and also before his signing of any agreement with TGL. It does not appear that the ISR itself gave him much, if any, information of additional value. Moreover, as Will acknowledged in his interview with the CRB, his own newly launched business (Tough Mudder) is potentially vulnerable to imitators, as there are few barriers to entry, other than brand recognition and general managerial skill.

The CRB does find, however, that Will violated our standards in connection with his Independent Student Research project (ISR) and participation in the HBS Business Plan Contest. (BPC). Specifically, the CRB finds sufffcfent evidence to conclude that Will violated thee HBS Community Values of ?honesty and integrity? and ?accountability? in several important respects.

For example, the plan he submitted for his own Tough Mudder business to the HBS BPC in the spring of 2009 included as an attachment ? ?Tough Guy Historical Income Statements ? including original accountant?s notes.? Will had signed an agreement with TGL titled ?Confidentiality Document? in October 2008 related to his ISR project. Among other things, it provided that Will would be given financial information about the company, subject to the condition that it would only be available to those ?connected with Will?s research project.?

Will contends that he was advised by counsel (his father) that this provision did not bar him from using this material in the HBS Business Plan Contest even though that meant that the material would be seen by a wider circle of people. This apparent argument is that the limitation was only meant to encompass disseminating information to third parties who intended to put it to direct use. That interpretation is
inconsistent with the plain meaning of the words; hence the CRB finds that Will violated the HBS Community Value of Integrity in not honoring his agreement with TGL.

If may be that this disclosure did not cause material harm to TGL, as the information is of a rather general nature and could likely be inferred without any special access to the company. TGL might well not agree with such a conclusion, however, and in any event could justifiably regard this as a breach of trust.

In his Interview, Will said that he included the material because the judges would expect to see some hard data (even though he also said he was skeptical about its accuracy). The fact that he consulted his father on this issue suggests that he was aware of possible impropriety, yet he apparently did not ask TGL if it shared his interpretation of the confidentiality document or approved of this use of company information. If other HBS students engaged in field work followed his example in regard to confidentiality agreements, the negative impact on the School?s reputation and its ability to secure field-based research opportunities could be significant.

The CRB also finds that Will violated the HBS Community Value of honesty on several occasions, notably in his communication with TGL. Some of the specific statements he made to TGL in e-mail correspondence may seem minor on their own, though together they seem to constitute a larger effort to misrepresent the role of Harvard faculty (and hence the institution) in the ISR project.

On September 7, 2008, he wrote in an e-mail to TGL, ?(T)he good news is that the university is very happy for me to conduct a study in the feasibility/logistics of expanding Tough Guy internationally. Based upon the initial report that I put together my professors think it is something with real potential and are really excited about.? Only one faculty member, Sunil Gupta, had signed on as adviser to Will?s ISR at that point. Will has offered no evidence to the CRB that others were involved or that Harvard University in a larger sense had knowledge of and was interested in his student project.

Then on October 1, 2008, Will emailed TGL, opening with an apology for not being in touch sooner because ?I am afraid I have been pretty busy here with mid-term exams.? In that same e-mail, W,ill also told TGL that ?I want to look at whether there is a risk that others will try to copy Tough Guy here in the US or operate something similar and what (if anything we should do to prevent this). There is a professor here who is a specialist in how to respond to people copying your business idea and what to do about it and pleasingly, he has agreed to help us on this.? The CRB did not ask Will who this person might be, but given the assurances in the same email about HBS faculty participation, we are left wondering if this statement is also false or intentionally misleading. In another part of this e-mail message, Will speaks of setting up focus group meetings with target markets (?e.g., running clubs, sports teams, military veterans etc.) and then offers the assurance that ?Harvard can help us set these up.? The CRB has no information to indicate that Harvard was going to provide this support. The thrust ? and apparent purpose of such statements is to leave an impression of significant Harvard faculty and administrative involvement in what in fact was one of literally hundreds of standard student projects underway at the same time. The CRB finds such statements to constitute a misrepresentation and thus a violation of HBS Community Values. Again, if other MBA students engaged in field-based research were to follow Will?s example, the reputation of the School would be compromised and the availability of field-based research opportunities likely would suffer, as well.

The CRB is concerned about the specific instances of dishonesty and misrepresentation. They are wrong In their own right and they violate HBS Community Values. Pragmatically, moreover, when such misrepresentations become apparent, they can raise doubts about the reliability of other unconfirmed statements. Will should appreciate that the examples noted above could prompt skepticism, rightly or wrongly, about some of his other assertions. For example, the CRB did not get a clear explanation of why Will registered the ?toughguyusa.com? domain name well before undertaking his ISR, or why he apparently did not reveal that fact while he was doing the study. (In the interview, he indicated that he did this as a protectiVe measure, in case some other kind of enterprise happened to take the name.)

The CRB did not take it upon itself to confirm the validity of various other statements that Will made while he was a student. For example, we do not have documentation of the medical conditions and rehabilitation routine that he said required him to put his plan to launch Tough Mudder upon graduation from HBS on hold and thus back out of an agreement to hire a fellow HBS student as a summer intern. Nor do we have evidence one way or the other to support the statement he made in our interview that his organization is already the largest donor to the Wounded Warrior charity. We certainly hope that is the case, but given the doubts sown by his other misrepresentations ? and the fact that his company is so young ? we cannot be sure.

We have not pursued each and every such question, however, as we have before us sufficient evidence of dishonesty and misrepresentation to warrant a conclusion that Will violated HBS Community Values in that regard.

(AP) ? Naming the first foreigner to serve as governor of the Bank of England since it was founded in 1694 might have been expected to cause a fuss. Yet the appointment of Canadian Mark Carney has won bipartisan praise in Britain.

That's because few people in the world have Carney's qualifications.

The Bank of Canada governor is a highly-educated economist with Wall Street experience who is widely credited with helping Canada dodge the worst of the global economic crisis. He gained a reputation along the way as a tough regulator who stood up to JPMorgan Chase CEO Jamie Dimon.

Moving to the top job at Canada's central bank just before the global financial crisis hit in 2008, Carney slashed interest rates to historic lows and was the first central banker to commit to keeping them at a historic-low level for a definite time, a step the U.S. Federal Reserve would follow.

Canada was spared a mortgage meltdown or subprime lending crisis, and its banks, more regulated and less leveraged than Europe's, are rated among the world's soundest. Britain, however, has endured a decade of economic turbulence, and seemed ready for a foreigner to shake up its central bank.

Besides his job as a central banker, Carney, 47, also heads the G-20's Financial Stability Board, a global supervisor of regulatory changes in the financial system. Carney's championing of stiffer regulation was highlighted in a run-in last year with Dimon. The Bank of Canada chief stood his ground in a closed-door meeting in Washington when Dimon directed a diatribe toward Carney over what the JPMorgan Chase chief called "anti-American" global reforms against banks.

"When there was pushback on the regulatory front he dug in his heels and made his case that, no, we shouldn't slow down, we should be pushing forward," said Craig Alexander, a Toronto-Dominion Bank economist.

"This is the sort of thing that makes him qualified to take on the challenge of the Bank of England because he's going to be materially involved in shaping regulatory reform of the financial system in London," he added. "So the fact that he would stand up for the regulatory regime is exactly the characteristic one would be looking for."

The transnational appointment is a mark of today's globalized world, while also echoing a past in which Canada was a part of the British Empire.

Like other central bankers, Carney is a former Goldman Sachs executive. He worked for 13 years in London, Tokyo, New York and Toronto, before being appointed deputy governor of the Bank of Canada in 2003. He has both financial industry and government regulatory credentials.

"He looks and sounds the part," CIBC World Markets economist Avery Shenfeld said. "He has the academic background, the gravitas and the experience to withstand the fray of central banking in a city like London."

Carney, from the remote northern town of Fort Smith in the Northwest Territories, gained a bachelor's degree in economics from Harvard University in 1988, and master's and doctoral degrees in economics from Oxford University. Like many Canadians, he played ice hockey, serving as a backup goalie for Harvard.

He lived in London for a decade and his wife and children are dual nationals. British Treasury chief George Osborne, announcing the surprise choice to the House of Commons on Monday, said Carney will apply for British citizenship. He takes up the new position July 1, succeeding Mervyn King, who has headed the bank since 2003.

Before Monday's announcement the frontrunner for the job was widely seen to be Paul Tucker, the bank's deputy governor. But Tucker was likely bypassed because of his embroilment in the Libor-fixing scandal. In July, he was forced to testify to lawmakers after emails emerged showing he had communicated with Bob Diamond, the ex-chief of Barclays, over the setting of the inter-bank interest rate.

Carney's appointment won bipartisan praise in Britain. Ed Balls, the opposition Labour Party's economics spokesman, called it "a good choice," while Osborne said Carney was "quite simply the best, most experienced and most qualified person in the world to do the job."

Although Osborne said it was the first time the Treasury advertised the governor's job, Carney said he hadn't applied. "I didn't apply as part of the formal process to the position. These discussions really only intensified in the last two weeks," Carney said at a news conference in Ottawa.

Carney said he initially turned down the job but British officials kept after him. He said he changed his mind because his term as governor of the Bank of Canada was ending soon, the London job was a big opportunity and the fate of the British economy was critical.

"It's very important for the global economy that the U.K. does well, that it succeeds in this rebalancing of their economy, that the reform of the British financial system is completed, " he said.

Carney said he would take the job for five years instead of the usual eight, and many Canadians are speculating that Carney may return to Canada to run for prime minister. The opposition Liberal Party of Canada had eagerly courted him, but Carney said this month he would remain a central banker for some time.

The Case Against Robots With License to Kill

Battlefield drones and robots capable of choosing their targets and firing without any human oversight won't arrive for a few decades, experts say. But a new Human Rights Watch report calls for an international ban on fully autonomous "killer robots" before they ever become a part of military arsenals around the world.

The thousands of drones and robots that the U.S. military already has deployed alongside troops are all controlled remotely by human operators, who can take responsibility if the machines accidentally injure or kill civilians. Fully autonomous robots capable of choosing targets and firing weapons on their own may come online within the next 20 or 30 years, if not sooner.

"Giving machines the power to decide who lives and dies on the battlefield would take technology too far,? said Steve Goose, the Arms Division director at Human Rights Watch. ?Human control of robotic warfare is essential to minimizing civilian deaths and injuries."

"Fully autonomous weapons" operating without oversight won't have the artificial intelligence, human judgment or empathy necessary to distinguish between armed soldiers and cowering civilians in murky battlefield conditions, Human Rights Watch says. Its joint report with Harvard Law School's International Human Rights Clinic argues robots could never follow rules of international humanitarian law. [5 Reasons to Fear Robots]

The report released on Nov. 19 suggests the following to stop the "killer robots" future:

  • Ban development, production and use of fully autonomous weapons through an international agreement.
  • Adopt national laws to ban the creation and use of fully autonomous weapons.
  • Keep watch on technologies and components that could lead to fully autonomous weapons.
  • Make a professional code of conduct to oversee research and development of autonomous robotic weapons.

The report also highlights concerns about the possible use of fully autonomous robots by dictators to brutally suppress their civilian populations, and about the easier decision to go to war when leaders aren't worried about troop casualties.

Robots may lack human empathy, but history already has shown that human soldiers are capable of committing the world's worst atrocities despite their supposed humanity. Ronald Arkin, a robotics researcher at Georgia Tech, even has argued that fully autonomous robots could make the battlefield safer: They wouldn't fall prey to the fatigue that can result in misidentifying targets, or to the anger that could lead to sadistic abuse of prisoners and civilians.

The U.S. military spends about $6 billion each year on developing and deploying thousands of drones and robots. Its huge arsenal includes ground robots rolling or walking along under direct human control, Reaper drones that can fly parts of their mission without human control, and robot boats capable of firing missiles.

Automatic defense weapons such as the U.S. Navy's Phalanx turret can fire thousands of rounds at incoming missiles without a human order and with only the barest human supervision. Israel's "Iron Dome" defense detects incoming threats and asks human operators to make a split-second decision on whether to give the command to fire missiles that can intercept enemy rockets and artillery shells.

Both Israel and South Korea also have deployed robot sentry turrets that could, in theory, operate on automatic mode.

Man accused of stealing Tim Allen's Chevy Impala

DENVER (AP) ? A man suspected of stealing one of Tim Allen's custom cars says the comedian left the keys so he could drive it to Denver.

Denver police spokesman Sonny Jackson said Monday that 34-year-old Faustino Ibarra is being held without bond while awaiting extradition to California after his arrest on Saturday.

In a jailhouse interview with KDVR-TV (http://bit.ly/TpJirK ), Ibarra claimed Allen adopted him years ago. Jackson said there is no evidence of any adoption.

Ibarra said Allen had left the door to his garage open along with the keys.

Police confirmed that the customized 1996 Chevrolet Impala SS belonged to the "Home Improvement" star but said it hadn't yet been reported stolen when it turned up in Denver.

Allen's publicist Marleah (mar-LEE-uh) Leslie said she wouldn't comment because it's a police matter.

Ubisoft CEO Yves Guillemot explained that he isn?t a huge fan of long gaps between new gaming consoles, according to Kotaku.

Although most people aren?t interested in spending a lot of money every few years for a brand new video game console, Guillemot explained that the gap is essentially bad for business. In fact, the Ubisoft CEO feels the longevity of the current generation may have ultimately harmed the industry.

?I think that what has happened is the transition has been very long,? Guillemot explained to Polygon. ?You know, in the industry, we were used to changing machines every five years. This time we are in the seventh year of the 360. We need new consoles and at the end of the cycle generally the market goes down because there are less new IPs, new properties, so that damaged the industry a little bit.?

He added, ?I hope next time they will come more often.?

Guillemot explained new consoles force game developers to try new things. Since a new console hasn?t come along in quite some time, the Ubisoft CEO feels that some designers are resting on their laurels by releasing sequel after sequel.

?When a console is out for a long time ? you don?t take as much risks on totally new IPs because even if they are good, they don?t sell as well,? he explained.

According to the Examiner, video game industry sales are down 25 percent. Since software developers aren?t willing to take a chance on new titles, many gamers are experiencing a problem generally associated with the motion picture business: sequelitis. Most of the top selling games released this holiday season are just new installments in previously-established franchises.

?Everybody who is taking risks and innovating is welcome because there are lots of hardcore gamers and those guys want new things, where the mass market will be more interested in having the same experience and doesn?t want to take as much risks because it?s not aware as much of what is going to change its experience. So, the beginning of the machines is always a good time for innovation,? Guillemot explained.

European lawmaker Strasser on trial for corruption

VIENNA (Reuters) - Disgraced Austrian politician Ernst Strasser goes on trial on Monday in a corruption case that has undermined trust in European and Austrian institutions.

The former Austrian interior minister and European lawmaker could face 10 years in jail if convicted, after being caught on camera offering to propose amendments to European laws in exchange for 100,000 euros ($130,000 a year).

Strasser, 56, was exposed last year by undercover journalists from Britain's Sunday Times posing as lobbyists. He resigned while denying wrongdoing, saying he wanted to protect his party, the Austrian conservative OVP.

"Of course I am a lobbyist," he told the journalists in a secretly filmed video. "This is a wonderful opportunity to learn all the people, to have my own network, and to use this network for my, for my companies. It's a very good combination."

Strasser, one of several once-mighty Austrian politicians brought down by recent corruption scandals, told the journalists he already had five such clients.

He later said in an interview he went along with the "lobbyists" because he believed they were secret service agents and he wanted to follow their trail.

The trial in Vienna comes as European politicians battle to keep faith with the post-war ideals of European integration and rejection of extreme nationalism that led to the founding of what would become the European Union more than 60 years ago.

As the 27 nation bloc struggles to contain a debt crisis, a gulf is widening between more affluent countries and poorer members like Greece, which faces expulsion from the euro zone if it does not maintain a course of harsh austerity measures.

Euroscepticism and nationalism are on the rise in many European countries. In Britain, which has always had a difficult relationship with its continental partners, talk that it could leave the EU has begun to shift from the fringes to the center of political debate.

Less than half of the EU's half a billion citizens voted in the last European Parliament elections in 2009, and a poll last year found that 26 percent had a negative image of the parliament, up from 17 percent three years earlier.

"Most European parliamentarians are as lazy as I am," Strasser told the Sunday Times journalists.

Three other European lawmakers were caught by the Sunday Times sting operation: Romania's Adrian Severin, Slovenia's Zoran Thaler and Spain's Pablo Zalba Bidegain.

Thaler resigned after the scandal but the other two still sit in parliament.

Eight days have been allotted for Strasser's trial, which begins at 0700 GMT and has drawn wide international interest. ($1 = 0.7717 euros)

Prof finds racial profiling in ads for data site

Dr. Latisha Smith, an expert in decompression sicknesses afflicting deep sea divers, has cleared criminal background checks throughout her medical career. Yet someone searching the Web for the Washington state physician might well come across an Internet ad suggesting she may have an arrest record.

"Latisha Smith, arrested?" reads one such advertisement.

Another says: "Latisha Smith Truth... Check Latisha Smith's Arrests."

Instantcheckmate.com, which labels itself the "Internet's leading authority on background checks," placed both ads. A statistical analysis of the company's advertising has found it has disproportionately used ad copy including the word "arrested" for black-identifying names, even when a person has no arrest record.

Latanya Sweeney is a Harvard University professor of government with a doctorate in computer science. After learning that her own name had popped up in an "arrested?" ad when a colleague was searching for one of her academic publications, she ran more than 120,000 searches for names primarily given to either black or white children, testing ads delivered for 2,400 real names 50 times each. (The author of this story is a Harvard University fellow collaborating with Sweeney on a book about the business of personal data.)

Ebony Jefferson, for example, often turns up an instantcheckmate.com ad reading: "Ebony Jefferson, arrested?" but an ad triggered by a search for Emily Jefferson would read: "We found Emily Jefferson." Searches for randomly chosen black-identifying names such as Deshawn Williams, Latisha Smith or Latanya Smith often produced the "arrested?" headline or ad text with the word "arrest," whereas other less ethnic-sounding first names matched with the same surnames typically did not.

"As an African-American, I'm used to profiling like that," said Smith. "I think it's horrendous that they get away with it."

Instantcheckmate.com declined to comment. The company's founder and managing partner, Kristian Kibak, did not respond to repeated emails and phone calls over a period of several months, and other employees referred calls to management. Company officials also declined to comment when visited twice at their call center in Las Vegas. Former employees said they had signed nondisclosure agreements that barred them from speaking openly about Instant Checkmate.

Instantcheckmate.com is one of many data brokers that use and sell data for a variety of purposes. The field is attracting growing attention, both from government and consumers concerned about possible abuse. Rapid advances in technology have opened up all sorts of opportunities for commercialization of data.

Anyone can set up shop and sell arrest records as long as they stay clear of U.S. legal limitations such as using the information to determine creditworthiness, insurance or job suitability.

Companies that compete with instantcheckmate.com include intelius.com and mylife.com. An examination of Internet advertising starting last March as well as Sweeney's study did not find any rival companies advertising background searches on individual names along racial lines.

Who can be trusted??
In its own marketing, Instantcheckmate.com sums up its mission like this: "Parents will no longer need to wonder about whether their neighbors, friends, home day care providers, a former spouse's new love interest or preschool providers can be trusted to care for their children responsibly."

According to preliminary findings of Sweeney's research, searches of names assigned primarily to black babies, such as Tyrone, Darnell, Ebony and Latisha, generated "arrest" in the instantcheckmate.com ad copy between 75 percent and 96 percent of the time. Names assigned at birth primarily to whites, such as Geoffrey, Brett, Kristen and Anne, led to more neutral copy, with the word "arrest" appearing between zero and 9 percent of the time.

A few names fell outside of these patterns: Brad, a name predominantly given to white babies, produced an ad with the word "arrest" 62 percent to 65 percent of the time. Sweeney found that ads appear regardless of whether the name has an arrest record attached to it.

Blacks make up about 13 percent of the U.S. population but account for 28 percent of the arrests listed on the FBI's most recent annual crime statistics.

Internet advertising based on millions of name pairs has only existed in recent years, so targeting ads along racial lines raises new legal questions. Experts say the Federal Trade Commission, which this year assessed an $800,000 penalty against personal data site Spokeo.com for different reasons (related to the use of data for job-vetting purposes), would be the institution best placed to review Instant Checkmate's practices.

The FTC enforces regulations against unfair or deceptive business practices. A deceptive claim that would be more likely to get people to purchase a product than they would otherwise would be a typical reason the FTC might act against a company, said one FTC official who did not want to be identified. For example, authorities could take action against a firm that makes misleading claims suggesting a product such as records exist when they do not.

"It's disturbing," Julie Brill, an FTC commissioner, said of Instant Checkmate's advertising. "I don't know if it's illegal ... It's something that we'd need to study to see if any enforcement action is needed."

Instant Checkmate's Kibak, who is in his late 20s, works out of a San Diego office near the Pacific Ocean. The son of a California biology professor, he did not respond to repeated phone calls and emails seeking comment about his business.

"We would consider the answers to most of your questions trade secrets and therefore would not be comfortable disclosing that information," Joey Rocco, Kibak's partner according to the firm's Nevada state registration, said in an email.

Instant Checkmate LLC maintains its official corporate headquarters at an address in an industrial zone across the highway from the Las Vegas strip. At the back of a long parking lot, the company shares a warehouse building with an auto repair shop. At one end, a large roll-up garage-style door opens to the company's call center. Workers face a gray cinder-block wall, their backs to the entrance. Staff declined to answer questions.

Data firms proliferate?
Sweeney's analysis found that some instantcheckmate.com ads hint at arrest records when the firm's database has no record of any arrest for that name, as is the case with her own name. In other cases, such as that of Latisha Smith, the company does have arrest records for some people by that name, although not for the doctor of hypobaric medicine in Washington state.

Laura Beatty, an Internet Marketing Inc expert in helping companies achieve prominent placement in Web searches, said instantcheckmate.com appeared to choose its ads based on combinations of thousands of different first and last names and then segment them based on the first names.

"There does look like there is some definite profiling going on here," she said. "In the searches that I looked at, it seemed like the more Midwestern- and WASP-sounding the name was, the less likely it was to have either any advertisement at all or to have something that was more geared around the arrest or criminal background."

Internet firms selling criminal records and personal data to the public have proliferated in recent years, as low-cost computing enables even modest operations to maintain large databases on millions of Americans. Such sites sell access to users for a one-time fee???$29.95 in the case of instantcheckmate.com???or via monthly subscription plans.

Instant Checkmate, first registered in Nevada in 2010, said in a recent press release posted online that the firm had attracted more than 570,000 customers since its start and counted more than 200,000 subscribers.

According to alexa.com, an Amazon.Com Inc site analyzing website traffic, instantcheckmate.com has ranged roughly between the 500th and 600th most visited U.S. site in recent weeks, making it an increasingly major player in this area.

The company is able to target its ads on an individual name basis through a program called Google AdWords. Instantcheckmate.com and others companies like it use Google AdWords to bid to place small text advertisements alongside search results on major websites triggered by the names in their data base. Such ads typically cost a company far less than a dollar, sometimes just a few pennies, each time they're clicked.

Google says it does not control what names appear in AdWords. "Advertisers select all of their keywords, and ads are triggered when someone searches for that name. We don't have any role in the advertiser's selection of unique proper names," said a Google spokesman.

Some in Congress have raised concerns about developments in the use of personal data. In October, Sen. John Rockefeller IV, a Democrat from West Virginia and chairman of the Senate Committee on Commerce, Science and Transportation, opened a probe into leading data brokers. "Collecting, storing and selling information about Americans raises all types of questions that require careful scrutiny," he said.

Snohomish County mental health court is aimed at breaking the ...

EVERETT ? A new mental health court has opened in Snohomish County to help find solutions for people living with mental illness who are caught in the criminal justice system.

The court is designed to solve issues that can't be easily addressed in a traditional court, The Daily Herald reported ( http://is.gd/ccRB5K).

So far, two people have opted into the program. A third person is in the early stages. The program could eventually manage 20 cases.

The pilot project is funded from a portion of a sales tax specifically collected to pay for services for those in the community living with a mental illness and those with substance abuse problems.

These cases would have been in the court system anyway, but are now being diverted to the mental health court in hopes of providing long-term solutions.

Participants likely will be someone "who has gone through the system over and over again," said Everett District Court Judge Tam Bui, who presides over the new court.

The goal is to help people get stable and healthy so they can get out of the cycle, proponents say.

"We're working out what we all need to do to make this a successful program," Snohomish County deputy prosecutor Hal Hupp said.

Hupp will decide whether defendants are legally eligible for the program, by looking at the current charge, as well as any past criminal history. The court generally isn't going to accept anyone charged with a felony and will avoid anyone with a past history of violence.

"We don't want the program to fail because we brought in the wrong person," Hupp said.

Participants who opt into the program must meet certain requirements, such as being engaged in treatment, meeting with court's mental health liaison and following the recommendations of health care providers. The program also requires regular court visits.

The judge, lawyers and a mental health liaison gather before the court hearings to talk about each participant's progress and if there are any additional issues that need to be addressed.

"These cases are expected to be dynamic because we're dealing with people's mental well-being," Bui said.

Participants get much more supervision than if their cases were left on the typical trial track, said Jennifer Bartlett, an attorney with the Snohomish County Public Defender Association.

"There will be more intervention earlier. There's just a lot more supervision and monitoring," she said.

The court will maintain jurisdiction over the cases for two years. If participants fail to meet the requirements, they face being convicted of the charge. If they successfully complete the program, the charge can be dismissed.

"Not only is it humane, but it's the most effective way to deal with this set of the population," Bui said.

Every week in?Slate?s?American Horror Story TV club, J. Bryan Lowder will have an IM conversation with a different?AHS fan. This week, he rehashes episode 2.6 with AHS superfan George Abbott.

J. Bryan Lowder: Happy Thanksgiving Eve Mr. Abbott, and welcome to the TV Club! After hearing all that talk of flesh tonight--touching it, missing it, cutting it--I wonder if you still have an appetite for your bird tomorrow...I have to say that was one doosy of an episode!

George Abbott: Honestly, I can eat anything if Thredson doesn't talk about wearing Clea DuVall's teeth again. I've been rabidly watching this show since the beginning, but last week was the only episode that actually gave me nightmares. And speaking of the upcoming holiday, how perfect was it that they sent us into decorative gourd season with maybe the show's best line ever: "Nutmeg makes all the difference?in the world." I'm going to find DOZENS of ways to use that in the next 5 days.

Lowder: Yes! I found this episode particularly scary--and well-crafted--myself (I believe Murphy was the writer), and also, despite the scariness, particularly campy? That nutmeg line you mention was divine, as was the new level of queen Quinto brought to our now unbuttoned Thredson. That, paired with his newly revealed infantilistic obsessions, just blew my mind. But I wonder, do you worry that two sites of horror--Thredson's basement and Briarcliff--will lessen the affect of both? I'm a little ambivalent about the world expanding outward too much.

Abbott: That's so funny, because I was thinking about how refreshing it was that this episode dealt with relatively few characters (even though, now that you mention it, they spent very little time at Briarcliff). My bigger concern is with the Bloodyface unhappy-childhood direction in general. I mean, next to some of the stuff Ryan Murphy's thrown at us (possession, rape, Nazis, etc.), I have to wonder if an orphanage and apparent lack of colostrum (which, yes, I had to look up after that scene) is enough to send someone down the serial killer track. Did it ring true for you?

Lowder: That's a great question (and you will have to tell me and our readers what colostrum is: The TV Club is all about sharing the knowledge)! I guess we have to expect some kind of gripping back-story for our serial killers, but I'm a little bummed they didn't just leave the "explanation" for his violent tendencies unclear. I find that inexplicable violence is more frightening than overly explained stuff. Though i do think that his self-theory was based on some real research--perhaps a commenter can tell us whether it still holds true?

Abbott: Oh - it's so gross. Colostrum = First Milk

Lowder: OMG, really? That's super gross. And I think we can assume that she wouldn't even be lactating, right? Unless she's secretly pregnant?

Abbott: Yeah, I'm pretty sure that was a... ahem... dry run. And I totally agree with you - once you've gotten into skin-lampshade territory, no background story is going to live up to the scariness of "skinning 33 year-olds alive is just his thing." But I have to get your take on one of the biggest questions of this episode: How... on earth... is this the first time that AHS has given us a super-creepy child WITHOUT some kind of mental illness/Down's? I can't believe that they held off on going into a "The Omen" space for so long!

Lowder: I hadn't even thought about that! Yes, the new affectless child was a welcome edition, and I'm glad you brought her up, because I thought her scene with Sister Mary Eunice was maybe my favorite of the episode. Their dry repartee was intoxicating. I'm kind of hoping Eunice will take her under her possessed wing and be an evil mentor--she will need a sidekick in the NEW ERA! Speaking of which, do you have any theories about her plans? She's clearly QBIC now that's she's got the dirt on Arden.

Abbott: I don't know about her plans, but if she wants to start her own church, I'm THERE. I actually wrote down "You were born with the gift of authentic impulse - don't ever let them kill it" like it was some Oprah-wisdom I needed to write on my mirror in lipstick every morning. MOVED. But I'm a little disappointed with her small moves so far. I mean, she's the devil, and all she's done so far is some gossip, some covering up, and some lingerie theft - I'm guessing she's trying to lead Arden to bring about some kind of zombie apocalypse, but I'd really rather she start a skanky Lesley Gore tribute band with Jude and take it on the road.

Lowder: I'm speechless. Your appraisal of Sister Mary is, like, Platonic. Are we soul mates? I don't have any concrete ideas, but I do tend to follow your logic (i.e. toward the drug-resistant zombie apocalypse). More machinations from her soon, please! Speaking of which, if I had to look like Shelly (bye bye Chloe Sevingy!) to survive the Russians' nuclear attack, I think I'll pass.

Ok, it's time to get back to cooking, so let's wrap it up with a final question--we were treated to another glimpse of the present day this evening, iPhones in severed limbs and all. What?s going on? Is Threadson still alive? Does he have acolytes? The voice on the phone sure sounded like him....

Abbott: Here's what I'm thinking: It's Threadson (it sounded A LOT like him on the phone), his plotline has dovetailed with Arden and he's some kind of age-resistant momma's boy zombie, and seriously NO ONE IN THE WORLD will care if he puts Megan Fox Lite out of her misery (how is that girl not dead yet???)

Lowder: Ha, totally. The colostrum mixed with the "immune boosting cocktail" and made him live forever, just so he could take out Channing Tatum's wife. Leaving him available?for me. Get into it. Alrighty, I'm going to get into some turkey stock real quick. Hope your holiday is as yummy as Thredson?s sandwich!
